Airbnb listings raise concerns over outsiders
Short-term rentals are rewriting that equation. What was once a home for a family or a long-term tenant can now effectively function as a hotel room, with a new guest arriving every few days, every night or even hourly basis.
India’s short-stay rules remain fragmented
The issue has been highlighted after a 28-year-old Gurgaon software engineer jumped off the 41st floor of an Airbnb apartment in Noida’s Supernova complex, though police said the incident had nothing to do with the rental. The man had checked into the apartment alone at around 3pm Friday and remained there for a day.
Debate grows over residential property use
The security issue is bigger than a guestThe problem for housing societies is not who has booked a room, but how often unknown people enter a residential society. The issue had become controversial at Supernova even before the death. The apartment owners’ association recently issued a warning to owners and tenants not to list flats on Airbnb, Oyo and Booking.com for short stays citing security concerns and complaints about guests coming and going at odd hours.The complex consists of three towers, with 582 residential units in Nova East and Nova West combined, while some 200 flats in Spira Tower between floors 19 and 43 are used for commercial purposes, the association said. All three towers have common gates and the same campus, and the movement of short-stay guests is a security concern for residents across the complex.Verifying residentsFor a normal tenant, societies generally get more time to get the police verification done, get the documents in place and find out who is staying in the flat. That process is greatly shortened by short term accommodation. A guest may come late at night, stay for one or two days and leave before neighbors or security guards get to know him.This creates a different operating environment for a residential complex security personnel deal with frequent check-ins, delivery agents, visitors and vehicles, while residents have little idea who is temporarily using the apartments around them. Supernova was also concerned after a short-stay operator allegedly ran a security barrier when guards tried to stop him from entering through the main gate. Police later found six pending e-challans of around Rs 36,000 linked to the vehicle.Residential-society rulebookThe bigger issue is that India’s rules for this fast-growing accommodation model are still fragmented. Not all Airbnbs or short-term rentals are automatically illegal. It is contingent upon state tourism policies, local regulations, sanctioned land use, property documents and the bye-laws of the housing society.The Union tourism ministry said in December 2025 that a report on homestays by the NITI Aayog had recommended states and Union Territories (UTs) to adopt best practices and harmonize regulations. Over 2000 registrations have already been done under Uttar Pradesh’s 2025 Bed and Breakfast and Homestay Policy, with about 750 certified by February 2026. The policy permits registered homestays in urban or rural areas, with a maximum of six rooms and 12 beds, provided the owner lives on the premises, among other conditions.The battle is spreading across cities nowThe friction is not restricted to Noida. Residents of Windsor Park in Vaibhav Khand, Ghaziabad, have raised concerns over alleged daily rentals, movement of outsiders and police verification. Residents of Bengaluru have also raised objections on the grounds of noise, parking and increased movement of outsiders to commercial activities in the form of homestays in residential neighborhoods.The legal battle has now moved to the courts of Mumbai. A cooperative court upheld restrictions imposed by a housing society on short-term accommodation, saying the activity was commercial in nature and different from normal long-term renting. The ruling did not ban Airbnb use across the country but reiterated the “importance of society bye-laws and local laws and regulations”.When does a house stop being a home?That is the defining question for India’s high-rise societies today. Short-term rentals provide a way for homeowners to monetize an expensive asset and cash in on the growing demand for flexible accommodation. However, for residents, the same apartment can be a source of uncertainty since the occupants are constantly changing. The discussion is therefore moving away from whether an owner should be permitted to profit from a property. It’s about whether a residential building can be used at the same time as a home for permanent residents and a hotel-like property for transient guests — without changing the security, privacy and character of the entire community.
