H1-B visa price hike gets extension till September 2027: How this will impact Indian engineers, technicians and others who want to work in the US
Donald Trump extends H-1B Visa price hike for another year

US President Donald Trump has extended sweeping restrictions on the H-1B non-immigrant visa route for an additional twelve months, keeping a mandatory $100,000 fee in place for specific foreign professionals, including technology workforce, looking to enter America. According to an official proclamation issued by the White House, the curbs originally implemented in September 2025 will now run through September 21, 2027. Administration officials stated the extension was required because the market conditions and alleged system abuses that triggered the initial rules continue to persist.

Key details of the $100,000 rule

Under the directive, foreign specialty occupation workers covered by the order cannot cross into the US unless their employer petitions include, or are supplemented with, a steep $100,000 payment. The payment condition hits employees situated outside the US who attempt to travel into the country after September 21, 2026.The Homeland Security Secretary retains discretionary authority to grant waivers for an individual worker, a corporate workforce, or an entire commercial sector. However, this applies solely if the employment is certified as vital to US national interests and presents no threat to domestic safety or welfare. The administration says that third-party staffing agencies and IT outsourcing providers have long manipulated the visa route to displace American personnel with cheaper offshore talent.“As explained in the 2025 Proclamation, the H-1B nonimmigrant visa program was created to bring temporary workers in high-skilled functions into the United States, but it has been exploited to replace, not supplement, American workers with lower-paid labor. Certain employers, including information technology (IT) staffing and outsourcing firms, have abused the system to suppress wages and displace American workers, and this has both harmed the labor market for American workers while also making it difficult to attract and retain the most highly skilled temporary workers. IT staffing and outsourcing firms were found to supply a large volume of entry-level temporary H‑1B workers, generally at a much lower salary compared to full‑time, traditional workers, and some of these firms later outsourced IT roles to cheap labor markets overseas. This has led to a proliferation of lower-paid foreign labor flooding the American labor market and making it difficult for American workers and recent graduates, especially in science, technology, engineering, and math (STEM) fields, to find employment.”

Why Indian engineers and skilled workers face the heaviest Blow

The decision delivers a hard setback to Indian software developers, engineers and technical personnel eyeing careers in the US. Indian citizens represent the overwhelming majority of program beneficiaries, making them uniquely vulnerable to rising regulatory costs.Official US government figures from USCIS FY2025 H-1B report earlier this year show that Indian candidates secured nearly 70% of all approved H-1B petitions. China placed second by a wide margin, accounting for only 12.1% of approvals.Under the old system, companies paid just $995 per applicant, which included a $215 lottery entry fee and an employer petition charge of $780. The new annual requirement of $100,000 is a more than 10,000% increase in costs and will require corporate sponsors to rethink how they hire internationally.The rule imposes a massive financial hurdle for overseas candidates, making it prohibitively costly for American companies to hire them. Industry analysts expect corporate sponsors to pull back on applications, likely triggering a sharp decline in overall visa grants.While senior specialists possessing niche, highly technical backgrounds may still secure backing, junior talent and early-career software developers face dwindling prospects as employers reconsider the heavy upfront investment.“The restriction imposed pursuant to subsections (a) and (b) of this section shall not apply to any individual alien, all aliens working for a company, or all aliens working in an industry, if the Secretary of Homeland Security determines, in the Secretary’s discretion, that the hiring of such aliens to be employed as H-1B specialty occupation workers is in the national interest and does not pose a threat to the security or welfare of the United States.”Last year, tech giants issued urgent travel advisories, triggering panic among foreign workers currently on leave or visiting family abroad, forcing corporate human resources teams to step in to protect their existing personnel.Major corporate employers, including Amazon, Microsoft, and JPMorgan, circulated urgent notices advising H-1B workers to remain stateside or immediately fly back to the US before the updated pricing rules take effect at midnight Saturday, September 20 2025.
