Los Angeles-based creator Shaka Smith, who has more than 700,000 followers, endorsed Democratic candidate Tom Steyer during the California governor\u2019s primary after being paid by his campaign.<span class=\"id-r-component br\" data-pos=\"5\"\/>\u201cHealthcare shouldn&#8217;t bankrupt you, housing should not feel impossible, polluters shouldn&#8217;t pass their bill to us and artists should not be replaced by AI,&#8221; Smith said. &#8220;That\u2019s why I\u2019m supporting Tom Steyer for governor.\u201d<span class=\"id-r-component br\" data-pos=\"9\"\/>Smith began the video with a disclosure, \u201cThis is an ad, and honestly, I wish more political content said that first.&#8221; His caption also identified the payment from Steyer\u2019s campaign.<span class=\"id-r-component br\" data-pos=\"11\"\/>According to a report by news agency AP, California is one of two states, along with Texas, requiring creators to disclose when they have been paid for political posts. Campaigns are increasingly working with smaller creators, sometimes with fewer than 100,000 followers, to reach specific audiences.<span class=\"id-r-component br\" data-pos=\"14\"\/>\u201cIf you\u2019re running for president and you are not currently trying to court some of these people or lining up your own people to act as surrogates for you, you\u2019re already behind,\u201d Mike Nellis, a democratic strategist who worked for Kamala Harris&#8217; presidential campaign, told the news agency.<span class=\"id-r-component br\" data-pos=\"16\"\/>Questions over disclosure have grown following cases involving paid political content that was not clearly identified as such.<span class=\"id-r-component br\" data-pos=\"19\"\/>AP reported, in 2022, the campaign of then-Senate candidate John Fetterman paid Nicole \u201cSnooki\u201d Polizzi of \u201cJersey Shore\u201d to make a video mocking his Republican rival. In 2023, creators were paid by an influencer marketing agency with conservative ties to defend Texas Attorney General Ken Paxton after his impeachment, according to The Texas Tribune. The payments were not clearly disclosed in either case.<span class=\"id-r-component br\" data-pos=\"21\"\/>Steyer, a democratic billionaire who spent more than $215 million of his own money on his unsuccessful governor\u2019s campaign, also faced criticism over payments to creators. <!-- -->While many creators disclosed that they were paid, California\u2019s campaign finance watchdog is investigating other cases in which creators allegedly did not.<span class=\"id-r-component br\" data-pos=\"25\"\/>California\u2019s disclosure law, passed in 2023, allows the state campaign watchdog to seek a court order requiring creators to disclose payments. The process can take months.<span class=\"id-r-component br\" data-pos=\"27\"\/>Democratic assemblymember Marc Berman has proposed legislation allowing the state\u2019s Fair Political Practices Commission to directly fine creators and political committees for violations. <!-- -->The proposed penalties could reach $5,000 per violation, according to the commission.<span class=\"id-r-component br\" data-pos=\"31\"\/>\u201cVoters should have a right to know whether or not campaigns are paying for the messaging that they\u2019re seeing,\u201d Berman said.<span class=\"id-r-component br\" data-pos=\"33\"\/>California senator Adam Schiff has introduced federal legislation, although it has not received a vote. The Federal Election Commission is also facing calls from outside groups to establish national rules.<span class=\"id-r-component br\" data-pos=\"36\"\/>Texas adopted a similar disclosure rule in 2024, while New York lawmakers are considering comparable legislation. Disclosure bills have also been proposed in Utah and Georgia but failed in recent years.<span class=\"id-r-component br\" data-pos=\"38\"\/>Smith said he produced two paid advertisements for Steyer, both carrying compensation disclosures. He said he was paid thousands of dollars and believed the posts influenced some followers.<span class=\"id-r-component br\" data-pos=\"41\"\/>\u201cThey kind of trust my voice,\u201d he said. \u201cThey knew that if I\u2019m saying it, it\u2019s at least something they should look into.\u201d<span class=\"id-r-component br\" data-pos=\"44\"\/>Creators remain divided over the proposed penalties. Dustin Torreverde, a Southern California creator who has not been paid by a political campaign, said disclosure was important but warned that legal costs could hurt smaller creators.<span class=\"id-r-component br\" data-pos=\"46\"\/>\u201cA lot of us are very small creators,\u201d he said. \u201cSo if we were to get penalized and we have to get lawyers, stuff like that, it\u2019s going to be very difficult for us.\u201d<span class=\"id-r-component br\" data-pos=\"48\"\/>Adina Flores, a libertarian creator in Northern California, said paid political posts should be disclosed and generally backed penalties.
