{"id":6421,"date":"2026-07-29T12:31:54","date_gmt":"2026-07-29T12:31:54","guid":{"rendered":"https:\/\/koshalsambada.in\/?p=6421"},"modified":"2026-07-29T12:31:54","modified_gmt":"2026-07-29T12:31:54","slug":"voter-card-aadhaar-bank-a-c-pan-not-citizenship-proof-hc-kolkata-news","status":"publish","type":"post","link":"https:\/\/koshalsambada.in\/?p=6421","title":{"rendered":"Voter card, Aadhaar, bank a\/c, PAN not citizenship proof: HC | Kolkata News"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<div class=\"e9jwa\">\n<div class=\"vdo_embedd\">\n<div class=\"GfdvZ\">\n<section class=\"_bIDB  clearfix id-r-component leadmedia undefined undefined  E9tg9 \" style=\"top:0px\">\n<div class=\"_bIDB\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">\n<div class=\"ypVvZ\">\n<div class=\"WGttI\"><img src=\"https:\/\/static.toiimg.com\/thumb\/msid-132711839,imgsize-120054,width-400,height-225,resizemode-75\/calcutta-high-court-stated-voter-cards-and-aadhaar-are-not-conclusive-proof-of-indian-citizenship.jpg\" alt=\"Voter card, Aadhaar, bank a\/c, PAN not citizenship proof: Calcutta high court\" title=\"Calcutta High Court stated voter cards and Aadhaar are not conclusive proof of Indian citizenship\" decoding=\"async\" fetchpriority=\"high\"\/><\/div>\n<\/div>\n<\/div>\n<div class=\"Ta7d_ img_cptn\"><span title=\"Calcutta High Court stated voter cards and Aadhaar are not conclusive proof of Indian citizenship\">Calcutta High Court stated voter cards and Aadhaar are not conclusive proof of Indian citizenship<\/span><\/div>\n<\/section>\n<\/div><\/div>\n<\/div>\n<p>KOLKATA: Neither one\u2019s voter card nor <a href=\"https:\/\/timesofindia.indiatimes.com\/topic\/aadhaar\" styleobj=\"[object Object]\" class=\"\" commonstate=\"[object Object]\" frmappuse=\"1\" target=\"_blank\" rel=\"noopener\">Aadhaar<\/a> nor bank account is conclusive proof of Indian citizenship, the Calcutta High Court has said, refusing to interfere in the state\u2019s proceedings regarding a \u201cMurshidabad man\u201d held in a detention centre for being a \u201cBangladeshi\u201d because of obvious discrepancies.<span class=\"id-r-component br\" data-pos=\"4\"\/>Nasir and his cousin, Suman Molla, were given repeated chances to prove that the former was an Indian citizen by descent, the court said.<span class=\"id-r-component br\" data-pos=\"6\"\/>Suman claimed that Nasir\u2019s father died in 1980 and he brought up Nasir, but the court noted that it was inclined to \u201cdisbelieve\u201d the contention as Nasir (46 years old, according to records) was older than Suman (38 years old).<span class=\"id-r-component br\" data-pos=\"8\"\/><span class=\"id-r-component br\" data-pos=\"10\"\/>The division bench of Justice Debangsu Basak and Justice Md Shabbar Rashidi also said Nasir and Suman did not come with \u201cclean hands\u201d; Suman claimed to be Nasir\u2019s cousin while being questioned by cops but, in court, said he was Nasir\u2019s uncle.<span class=\"id-r-component br\" data-pos=\"14\"\/>Suman\u2019s lawyer was also allowed to call Nasir, held at the Lalgola detention centre, to know the whereabouts of the latter\u2019s mother.<span class=\"id-r-component br\" data-pos=\"16\"\/>Nasir responded that both his parents were dead and buried but could not specify the location.<span class=\"id-r-component br\" data-pos=\"18\"\/>A DNA test could have been done to ascertain matters if Nasir could specify the burial spot, the court noted.<span class=\"id-r-component br\" data-pos=\"20\"\/>The state\u2019s counsel, on the first day of the hearing, told the division bench that Nasir had admitted in custody that he was a Bangladeshi national who had illegally entered India years back.<span class=\"id-r-component br\" data-pos=\"23\"\/>The court opted not to enter into the debate on whether the admission made while in detention could have the same consequences for the case as an admission made to cops while in their custody.<span class=\"id-r-component br\" data-pos=\"25\"\/>\u201cEven if we are to apply the principle that an admission made in the custody of the police should be discarded, nonetheless, the onus of establishing citizenship remains with the detainee,\u201d the bench held.<span class=\"id-r-component br\" data-pos=\"28\"\/>Nasir could not produce a birth certificate either, though Suman \u2014 on Nasir\u2019s behalf \u2014 produced a voter card, an Aadhaar card, a PAN card and a United Bank of India passbook.<span class=\"id-r-component br\" data-pos=\"31\"\/>\u201cA voter identity card is not conclusive proof of Indian citizenship. It is evidence of the detainee\u2019s enrolment on electoral rolls,\u201d the court said, noting that Nasir\u2019s name was deleted from the electoral roll in the SIR process. \u201cAadhaar, too, cannot by itself be conclusive proof of Indian citizenship,\u201d the court said, making the same observation about PAN and the bank account.<\/div>\n<p><br \/>\n<br \/><a
