If the ECI has been guided by the private party, then what remains? You cannot take assistance from a private party,\u201d justice Krishna Rao told the EC counsel, prompting the latter to clarify that he was \u201cnot being guided\u201d by Democratic Trinamool\u2019s counsel.<span class=\"id-r-component br\" data-pos=\"4\"\/>The court was hearing an appeal by ISF against EC\u2019s decision to allot \u2018envelope\u2019, the symbol with which it contested Lok Sabha polls and the 2026 assembly polls, to Democratic Trinamool for the upcoming bypolls in Nandigram and Rejinagar.<span class=\"id-r-component br\" data-pos=\"8\"\/>Pursuant to the bench\u2019s question whether the Commission could legally allot the symbol to Democratic Congress, EC counsel Jishnu Chowdhury submitted that \u2018envelope\u2019 was a \u2018common symbol\u2019 given to ISF, a registered but unrecognised political party, to fight just the assembly election and such an allocation did not create a right for ISF to seek the same symbol for the bypolls.<span class=\"id-r-component br\" data-pos=\"11\"\/>He also submitted that a by-election was not a continuation of the assembly election, as argued by ISF.<span class=\"id-r-component br\" data-pos=\"14\"\/><\/p>\n<div data-pos=\"0\" class=\"id-r-component iIpbx undefined  &#10;        \">\n<div><img decoding=\"async\" alt=\"Envelope as temporary symbol to DTC\" msid=\"134554253\" imgsize=\"46979\" resizemode=\"4\" width=\"\" title=\"Envelope as temporary symbol to DTC\" placeholdersrc=\"https:\/\/static.toiimg.com\/photo\/83033472.cms\" offsetvertical=\"0\" placeholdermsid=\"47529300\" type=\"thumb\" class=\"\" src=\"https:\/\/static.toiimg.com\/photo\/imgsize-46979,msid-134554253\/envelope-as-temporary-symbol-to-dtc.jpg\" data-api-prerender=\"true\"\/><\/p>\n<p>Envelope as temporary symbol to DTC<\/p>\n<\/div>\n<\/div>\n<p>The EC counsel added that symbol allotment was the commission\u2019s discretion and it had acted according to law by allotting \u2018envelope\u2019 to Democratic Trinamool and \u2018almirah\u2019 to ISF.<span class=\"id-r-component br\" data-pos=\"17\"\/>ISF\u2019s counsel, senior advocate Bikash Ranjan Bhattacharyya, argued that such discretion should be exercised \u201creasonably and rationally\u201d and \u201ccannot be absolute like an autocrat.\u201d<span class=\"id-r-component br\" data-pos=\"19\"\/>Calling the symbol reassignment an \u201cabsolutely illegal\u201d act, Bhattacharyya suggested that the bypoll could be deferred and doing so would not lead to a constitutional crisis.<span class=\"id-r-component br\" data-pos=\"21\"\/>The judgment in the case has been reserved.<\/div>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/timesofindia.indiatimes.com\/city\/kolkata\/cal-hc-if-ec-guided-by-pvt-party-then-what-remains\/articleshow\/134549937.cms\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Calcutta high court scrutinized the Election Commission&#8217;s handling of symbol allocation amid a political dispute.
