Then, with the tenant\u2019s knowledge of the change in ownership, the new owner can charge rent for the remaining tenancy period.<\/p>\n The tenant’s right to recover the security deposit is not affected by the sale of the property. While the Transfer of Property Act does not specifically deal with security deposits, Section 109 provides that the purchaser succeeds to the rights and, in appropriate cases, the liabilities of the original landlord in relation to the tenancy.At the end of the tenancy, the security deposit must be refunded after adjusting any lawful deductions, such as unpaid rent or damage beyond normal wear and tear, in accordance with the tenancy agreement.
