NEW DELHI: The Supreme Court<\/a> on Tuesday resumed final hearing on pleas challenging the Maharashtra Speaker\u2019s refusal to disqualify MLAs of the Eknath Shinde-led Shiv Sena<\/a> faction, with the group defending the Election Commission<\/a>\u2019s decision to recognise it as the \u201creal\u201d Shiv Sena.A bench headed by Chief Justice of India Surya Kant and comprising Justices Joymalya Bagchi and V Mohana is also hearing the Uddhav Thackeray faction\u2019s challenge to the EC\u2019s February 17, 2023, order allotting the Shiv Sena name and \u2018bow-and-arrow\u2019 symbol to the Shinde camp.\u2018EC can examine party structure\u2019<\/span>Senior advocate Neeraj Kishan Kaul, appearing for the Shinde faction, argued that the EC was empowered under Article 324 to examine a party\u2019s constitution and organisational structure while deciding which faction represented the real party.\u201cYour Lordships must see the entire record. The question is whether the constitution was with the Election Commission,\u201d Kaul said.He said the constitution relied upon by the Thackeray faction was not registered with the EC, while the 1999 constitution was submitted after detailed correspondence with the poll panel.<\/p>\n
