The dispute began in 1964, when local businessman Dean Brimhall built a modern service station and lodge along State Route 24, near the sandstone cliffs of the Waterpocket Fold. The property was privately owned but was surrounded by federally managed monument land.The petrol station and lodge served the growing number of motorists visiting Wayne County. The business later expanded into industrial stone quarrying. Quarrying sandstone and gravel near protected public land quickly became a concern for federal land managers.National Park Service records describe how the quarry work, heavy machinery, and new structures were seen as inconsistent with the natural landscape and the purpose of the monument.Years of disagreements, environmental concerns, and regulatory disputes followed as federal officials tried to stop the industrial activities.<\/p>\n

Negotiations led to a federal buyout<\/h2>\n<\/p>\n

After years of disagreement, the U.S. Department of the Interior moved to acquire the private property.Government officials and the landowners negotiated for several years before reaching an agreement. The federal government paid $400,000 for the property, including the land, commercial buildings, business assets, and mineral claims.After the property was transferred to the federal government, crews removed the commercial facilities. The tourist lodge was demolished, the petrol pumps were removed, the service station was dismantled, and the quarry was closed. The land was then restored to a more natural condition.<\/p>\n

Pioneer settlement shaped the property rights debate<\/h2>\n<\/p>\n

The dispute over the petrol station reflected a larger history of private land ownership in Wayne County. Private settlers had been living and working in the area long before federal protection expanded.According to the National Park Service Fact Guide, Mormon pioneers established the community of Fruita around 1880. They planted fruit orchards along the Fremont River and built small farms and homes.President Franklin D. Roosevelt designated Capitol Reef as a national monument on August 2, 1937, under the Antiquities Act. The designation initially protected 37,711 acres. However, private properties, farming claims, and mining holdings remained inside and around the monument.When Utah State Route 24 was paved through the Fremont River Canyon in 1962, visitor traffic increased sharply. Better access encouraged private landowners to build businesses and tourist facilities, creating new conflicts with park officials who wanted to protect the area’s natural scenery.<\/p>\n
