The type of land title determines what you can do with the property, how secure your ownership is and what restrictions may apply.<span class=\"id-r-component br\" data-pos=\"2\"\/>Land ownership in India can take different forms depending on the nature of the property and the laws applicable in a particular state. While freehold and leasehold are the most common terms in urban real estate, India also has state-specific forms of land tenure such as patta, bhumidhari and raiyati rights.<span class=\"id-r-component br\" data-pos=\"4\"\/>Land administration is largely handled by states, which means the terminology and rights attached to different forms of landholding can vary across the country.<span class=\"id-r-component br\" data-pos=\"8\"\/>Here\u2019s a look at the major types of land ownership and tenure rights you should know about before buying property:<span class=\"id-r-component br\" data-pos=\"10\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Freehold ownership<\/span><span class=\"id-r-component br\" data-pos=\"12\"\/>Freehold is generally the simplest form of property ownership. The owner holds the property without a fixed lease period and can generally sell, transfer, gift or mortgage it, subject to applicable laws and restrictions.<span class=\"id-r-component br\" data-pos=\"14\"\/>Freehold properties are common in residential plots, independent houses and some apartments. Since there is no fixed lease period, they are generally preferred by buyers and can be easier to transfer. However, freehold does not automatically mean that a property has a dispute-free title. The ownership history and relevant land records still matter.<span class=\"id-r-component br\" data-pos=\"18\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Leasehold ownership<\/span><span class=\"id-r-component br\" data-pos=\"20\"\/>Under leasehold ownership, a person gets the right to possess and use a property for a specified period and under conditions mentioned in the lease. <!-- -->The underlying land remains with the lessor, which could be the government, a development authority, an institution or another landowner. The lease deed generally specifies the duration of the lease, ground rent, conditions for transfer, permitted use and other restrictions.<span class=\"id-r-component br\" data-pos=\"24\"\/>Some leasehold properties can also be converted into freehold, depending on the applicable rules. The Delhi Development Authority, for example, has provisions for conversion of eligible leasehold properties into freehold.<span class=\"id-r-component br\" data-pos=\"27\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Government-allotted property<\/span><span class=\"id-r-component br\" data-pos=\"29\"\/>Government departments and development authorities allot land and residential properties under different schemes. An allotment letter does not necessarily mean that the recipient has acquired unrestricted ownership. The nature of the rights depends on the terms of the allotment and subsequent documents, such as a lease deed or conveyance deed.<span class=\"id-r-component br\" data-pos=\"31\"\/>Government-allotted properties can therefore ultimately be held under different arrangements, including leasehold and freehold structures.<span class=\"id-r-component br\" data-pos=\"34\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Patta land<\/span><span class=\"id-r-component br\" data-pos=\"36\"\/>Patta is a commonly used term in land and revenue records in several Indian states. However, it does not have one uniform meaning across the country.<span class=\"id-r-component br\" data-pos=\"38\"\/>Depending on the state and the type of land, a patta may record or establish recognised rights over a parcel of land. The nature of those rights, including whether the land can be transferred, depends on the applicable state law. Therefore, patta should not automatically be treated as synonymous with freehold ownership throughout India.<span class=\"id-r-component br\" data-pos=\"41\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Bhumidari rights<\/span><span class=\"id-r-component br\" data-pos=\"43\"\/>Bhumidari is a form of land tenure recognised under the laws of some states, particularly in relation to agricultural land. Uttar Pradesh, for example, recognises bhumidhars with transferable rights as well as bhumidhars with non-transferable rights under the Uttar Pradesh Revenue Code.<span class=\"id-r-component br\" data-pos=\"45\"\/>This distinction is important because the ability to sell or transfer the land can depend on the category of bhumidhari rights held by the person.<span class=\"id-r-component br\" data-pos=\"48\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Raiyati rights<\/span><span class=\"id-r-component br\" data-pos=\"50\"\/>Raiyati rights are another form of land tenure found in parts of India, particularly in relation to agricultural land. The exact meaning and legal rights attached to raiyati land depend on the applicable state legislation. Such rights can provide legally recognised possession and cultivation rights while also being subject to restrictions on transfer.<span class=\"id-r-component br\" data-pos=\"52\"\/>Raiyati rights therefore should not automatically be equated with unrestricted freehold ownership.<span class=\"id-r-component br\" data-pos=\"55\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Apartment ownership<\/span><span class=\"id-r-component br\" data-pos=\"57\"\/>For urban buyers, apartment ownership is another major form of property ownership. When a person purchases a flat, the buyer generally acquires ownership of the individual apartment along with the rights and interests in common areas and facilities provided under the applicable law and project documents.<span class=\"id-r-component br\" data-pos=\"59\"\/>The underlying land can have a separate ownership structure. For example, the land beneath an apartment project may itself be freehold or leasehold. <!-- -->This means ownership of a flat and ownership of the underlying land are related but are not necessarily identical concepts.<span class=\"id-r-component br\" data-pos=\"63\"\/><span class=\"strong\" data-ua-type=\"1\" onclick=\"stpPgtnAndPrvntDefault(event)\">Cooperative or society-based ownership<\/span><span class=\"id-r-component br\" data-pos=\"65\"\/>Some residential properties are developed or held through cooperative housing societies or similar legal structures. The rights of individual members depend on the society&#8217;s legal structure, the title to the land, the conveyance or lease arrangement and the applicable state laws.<span class=\"id-r-component br\" data-pos=\"69\"\/>As a result, cooperative housing properties cannot be treated as one uniform category of ownership across India.<span class=\"id-r-component br\" data-pos=\"71\"\/>The key point is that these terms do not carry exactly the same meaning across every state.
